By signing up and using SmartCallBot, you agree to these Terms. If you do not agree, do not use our service.

By accessing or using SmartCallBot, you:

If you are using SmartCallBot on behalf of a company, you agree that you have authority to bind the company to these Terms.

2. SmartCallBot Services

SmartCallBot provides AI-powered call answering, routing, appointment booking, voicemail transcription, and analytics services for small businesses.

  • Appointment scheduling

  • Voicemail transcription

  • Call analytics (future feature)

3. User Accounts & Responsibilities

To use SmartCallBot, you must create an account and provide accurate business and contact information.

🔹 Account Security:

  • You are responsible for keeping your login credentials confidential.

  • You must notify us immediately if you suspect unauthorized access to your account.

🔹 Prohibited Uses:

  • Do not use SmartCallBot for spam, fraud, illegal activity, or harassment.

  • Do not attempt to reverse-engineer or disrupt our services.

Failure to follow these rules may result in account termination (see Section 7).

4. Call Recording & Data Usage

  • By using SmartCallBot, you consent to call recording and transcription.

  • You must inform your callers that their calls may be recorded if required by law.

  • We use call recordings & transcripts to improve AI performance and analyze service quality.

5. Payments, Fees & Billing

💰 Pricing Structure

  • SmartCallBot charges a monthly platform fee + usage-based fees (per-call or per-minute).

  • Pricing is available at https://smartcallbot.com.

💳 Billing & Payment Processing

  • All payments are processed via Stripe.

  • You must provide valid payment information before using SmartCallBot.

Failure to Pay

  • If your payment fails, we may suspend or terminate your account.

🚀 Refunds & Cancellations

  • We do not offer refunds for completed billing cycles.

  • You may cancel your subscription at any time, but no refunds will be provided for unused time.

6. Service Availability & Limitations

SmartCallBot is a cloud-based AI service, and we strive for 99% uptime. However, we:
⚠️ Do not guarantee uninterrupted service.
⚠️ May perform maintenance or updates, sometimes without prior notice.
⚠️ Are not responsible for outages caused by third-party providers (e.g., Twilio, OpenAI, Stripe).

7. Account Suspension & Termination

We reserve the right to suspend or terminate your account if you:
❌ Violate these Terms or our Privacy Policy.
❌ Use SmartCallBot for illegal or abusive purposes.
❌ Fail to make payments.

Upon termination:
⚠️ Your access will be revoked immediately.
⚠️ We may delete your data, including call transcripts & recordings.

8. Intellectual Property & Licensing

All content, technology, and AI services provided by SmartCallBot are owned by us or licensed to us.

You may not:
❌ Copy, modify, or resell SmartCallBot.
❌ Use our AI responses outside of the intended service.

9. Limitation of Liability

🚨 We are not responsible for:

  • Loss of business revenue due to call handling errors.

  • Missed appointments or incorrect call routing caused by AI limitations.

  • Service downtime or third-party disruptions (e.g., Twilio, OpenAI).

📌 Liability Cap:
If you suffer damages due to SmartCallBot, our total liability shall not exceed the amount you paid us in the last 3 months.

📌 No Warranties:
SmartCallBot is provided "as is" and "as available". We do not guarantee perfect AI accuracy.

10. Dispute Resolution & Governing Law

⚖️ U.S. Laws Apply

  • These Terms are governed by the laws of Oregon.

  • Any disputes must be resolved in courts located in Oregon.

🤝 Dispute Resolution Process

  • Before filing a lawsuit, you must contact us to attempt a resolution.

  • If unresolved, disputes shall be resolved through binding arbitration (except for small claims court).

11. Changes to These Terms

We may update these Terms at any time. If we make major changes:
